General Terms and Conditions of the TICKET.AT Club

of WT Wien Ticket GmbH, Hütteldorfer Straße 2f, 1150 Vienna (hereinafter referred to as "TICKET.AT"):

1. Scope of application and membership

1.1. These General Terms and Conditions ("GTC") apply to the membership of the TICKET.AT Club.

1.2. Any natural person of legal age may become a TICKET.AT Club member, who uses the services for private purposes. Commercial use of the TICKET.AT Club is excluded.

1.3. Membership of the TICKET.AT Club and the services for Club members are free of charge unless otherwise agreed.

1.4. In the course of applying for registration as a participant in the TICKET.AT Club or after registration with a valid e-mail address via the account settings, the member expressly agrees to the present TICKET.AT Club General Terms and Conditions.

1.5. For the purchase of tickets brokered via TICKET.AT, the TICKET.AT General Terms and Conditions also apply; for lotteries, the TICKET.AT Conditions of Participation apply.

2. Services for TICKET.AT Club members

2.1. TICKET.AT Club members receive free information, mailings about events or benefits granted exclusively to Club members.

2.2. There is no entitlement to the granting of certain club benefits, unless these are expressly mentioned below.

2.3. A Club member who achieves a card price turnover of € 250 (incl. VAT) within a calendar year will receive a credit note of 2.5% of the card price turnover achieved in the previous year in the first quarter of the following year.

2.4. The accumulated credit expires with regard to the free membership at the end of the calendar year in which it was issued. For example, a credit achieved in September 2024 and issued in the first quarter of 2025 will expire on 31. December 2025.

2.5. Sales include all bookings made online via www.ticket.at and in the TICKET.AT Call Center at +43 1 5888 5888. The turnover is only allocated to the corresponding account via the e-mail address given at the time of booking. Subsequent changes are not possible. The club member is solely responsible for providing the correct email address during the booking process.

2.6. TICKET.AT reserves the right to restrict the granting of credits to certain events or to exclude individual events (e.g. in the case of special promotions).

2.7. TICKET.AT reserves the right to cancel the corresponding turnover on the credit account in the event of any withdrawal from the purchase (contract cancellation, rescission, withdrawal, etc.) for which the Club member was granted a credit note, as well as in the event of incorrect bookings and misuse.

2.8. It is not possible to transfer the credit to third parties.

2.9. Wien Ticket reserves the right to withhold or not grant the credit of the corresponding Wien Ticket Club member if there are justified indications of commercial use (e.g. due to a high number of ticket resales).

2.10. The credit note issued by TICKET.AT can be redeemed when ordering via TICKET.AT by quoting the corresponding voucher number. The redemption of credit notes is also possible after termination until the end of the validity of the credit note.

2.11. Club members can log in online under "My TICKET.AT" and view their purchase data and the sales made. Objections to the accuracy or completeness of this sales data can only be made in writing to TICKET.AT with proof of the original purchase receipt.

2.12. The Club member will also receive a TICKET.AT birthday voucher at the beginning of the month of birth. This voucher will only be sent by newsletter if the club member has given valid consent and a valid email address and date of birth have been provided.

3. Termination of the contract and amendments to the General Terms and Conditions

3.1. The Club member is entitled to terminate the membership of the TICKET.AT Club at any time by sending a written notification to TICKET.AT (1150 Vienna, Hütteldorfer Straße 2f; e-mail: kundenservice@wien-ticket.at or kundenservice@ticket.at). In this case, the accumulated credit balance and the entitlement to a credit note from it in accordance with point 2.2. shall expire. Credit notes already issued shall remain unaffected by this.

3.2. Termination by TICKET.AT is possible with a notice period of 4 weeks to the end of the calendar year. This must be in writing (email is sufficient). The right to extraordinary termination remains unaffected. Credit notes already issued also remain unaffected by this.

3.3. TICKET.AT is entitled to block a membership immediately for important reasons or to suspend it until the important reasons have been clarified. Good cause shall be deemed to exist in particular if the Club member provides incorrect data during registration, transfers or assigns benefits from Club membership to third parties or otherwise misuses Club membership (e.g. for commercial purposes). In the event of termination for good cause, all claims and benefits arising from Club membership shall lapse with immediate effect.

4. Final provisions

4.1. The exclusive place of jurisdiction for all disputes with companies arising from this contract and for consumer transactions where the consumer is neither domiciled or habitually resident in Austria nor employed in Austria at the time the action is brought shall be the court with local and subject-matter jurisdiction for 1010 Vienna.

4.2. The substantive law of the Republic of Austria shall apply exclusively, excluding the conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods. In the case of consumers, this choice of law shall only apply insofar as mandatory provisions of the law of the country in which they have their habitual residence are not superseded.
